Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern the use of the Lukian platform ("Platform", "Service"), including the Lukian CRM application and its social media publishing feature Lukian Social (which supports TikTok, Meta — Facebook and Instagram — and LinkedIn), operated by Lukian CORP SRL ("Lukian", "we", "our"), headquartered at Aleea Murelor nr.10A, Sp. Com.1, Constanța, România, CUI 45484296, J2022000113139. By accessing or using the Platform, you accept these Terms in their entirety.

2. Definitions

"User" — any individual or legal entity that accesses or uses the Platform.

"Account" — the account created by the User to access Platform features.

"Workspace" — the working space of a real estate agency, which may include multiple users.

"Content" — any data, photographs, texts, properties, or other materials uploaded by the User.

"AI Services" — features based on artificial intelligence (photo editing, text generation, automated valuations, conversational bots).

3. Account Creation

To use the Platform, you must create an Account. You agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your access credentials and for all activities performed through your Account.

We reserve the right to suspend or close Accounts that violate these Terms or are used fraudulently.

4. Platform Usage

You agree to use the Platform only for lawful purposes and in accordance with these Terms. The following is prohibited:

• Using the Platform for illegal or fraudulent activities.

• Uploading content that infringes third-party intellectual property rights.

• Attempting unauthorized access to our systems or other users' data.

• Using WhatsApp bots for spam or unsolicited messages outside the legal framework.

• Reselling access to the Platform without our written consent.

5. AI Services and Limitations

The AI Services provided by the Platform (photo editing, description generation, automated valuations, conversational bots) use artificial intelligence models supplied by third parties (Anthropic, OpenAI, fal.ai). AI-generated results are indicative, and we do not guarantee their accuracy, completeness, or suitability.

Automated property valuations are estimates based on market comparables and do not constitute certified valuations under applicable legislation. For official valuations, please consult an authorized ANEVAR evaluator.

6. Intellectual Property

The Platform, including source code, design, logos, and original content, is the property of Lukian CORP SRL and is protected by copyright and intellectual property laws.

Content uploaded by the User (photos, descriptions, property data) remains the User's property. By uploading, you grant us a limited, non-exclusive license to process and store this content for the purpose of providing the Service.

7. Payments and Subscriptions

The Platform offers a free trial period of 14 days. After the free period expires, access to features is conditional on purchasing a paid subscription.

• Payments are made monthly or annually, in advance.

• Prices may be changed with a minimum of 30 days' notice.

• Unused AI credits do not carry over to the following month.

• Refunds are granted in accordance with our refund policy.

8. Limitation of Liability

The Platform is provided "as is." We do not guarantee that the Service will operate without interruption or errors. We are not responsible for:

• Financial losses resulting from the use of automated valuations.

• Consequences of messages sent through WhatsApp bots.

• Inaccuracies in AI-generated content.

• Temporary unavailability of third-party services (Meta, Anthropic, OpenAI).

Our total liability is limited to the amount paid by the User for the Service in the last 12 months.

9. Termination

You may terminate your Account at any time from the Platform settings. Upon termination, your data will be deleted within 30 days, in accordance with our privacy policy.

We reserve the right to terminate or suspend your Account in case of violation of these Terms, with 7 days' prior notice, except in cases of serious breach where suspension may be immediate.

10. Changes to the Terms

We reserve the right to modify these Terms. Significant changes will be communicated by email at least 30 days before taking effect. Continued use of the Platform after modification constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of Romania. Any dispute will be resolved by the competent courts in Romania, in compliance with the mandatory mediation procedures provided by law.

12. Social Media Publishing (Lukian Social)

Lukian Social is the social media publishing feature of the Lukian CRM application. It enables Users to publish and schedule content to their own accounts on TikTok, Meta (Facebook, Instagram) and LinkedIn.

By connecting a social media account to Lukian Social, you authorize us to access only the data and permissions strictly necessary to publish content on your behalf and to display basic publish-state or engagement metrics for content you authored through Lukian CRM. Lukian Social does not access private messages, follower lists or personal data of people who interact with your content, and does not use the data obtained through these integrations for advertising or profiling.

You remain responsible for the content you publish through Lukian Social and for complying with the terms of service and community guidelines of each connected platform (TikTok Terms of Service, Meta Platform Terms, LinkedIn User Agreement). You can disconnect any social media account at any time from the Social Media section of Lukian CRM; upon disconnection, we immediately delete the corresponding access and refresh tokens and any cached account metadata. You may also revoke Lukian Social's access directly from the respective platform (e.g. TikTok → Settings → Manage connected apps).
